Introduction

Welcome to Afro-Asian Express! These Terms and Conditions (“Terms”) govern your use of our multi-vendor e-commerce platform (“Platform”), available at www.afro-asianexpress.co.uk or via our mobile application. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use our services.

Definitions

  • “Company” refers to Afro-Asian Express, the owner of the Platform.
  • “Platform” refers to the website and/or mobile application where vendors sell their products and buyers make purchases.
  • “Vendor” refers to a business or individual who offers goods or services for sale on the Platform.
  • “Buyer” refers to an individual or entity purchasing goods or services from the Platform.
  • “User” refers to any individual accessing the Platform, including both Vendors and Buyers.

Eligibility

To use the Platform, you must be at least 18 years old and have the legal capacity to enter into these Terms. By using the Platform, you represent and warrant that you meet these eligibility requirements.

Account Registration

  • Vendors and Buyers must register for an account to access certain features of the Platform. You agree to provide accurate and complete information during registration and to keep your account information updated.
  • You are responsible for maintaining the confidentiality of your account credentials and are liable for any activities that occur under your account.

Vendor Obligations

  • Vendors are responsible for the accuracy, legality, and quality of the products they list on the Platform.
  • Vendors must comply with all applicable laws, regulations, and industry standards in listing and selling their products.
  • Vendors agree not to engage in any fraudulent or deceptive practices, including but not limited to misrepresenting product descriptions, pricing, or availability.

Buyer Obligations

  • Buyers are responsible for reading and understanding product descriptions, terms of sale, and return policies before making a purchase.
  • Buyers agree to provide accurate information when placing orders and to promptly pay for all purchases.

Order Processing and Fulfillment

  • The Platform facilitates transactions between Buyers and Vendors. However, Afro-Asian Express is not a party to these transactions and does not assume liability for any issues arising from them.
  • Vendors are solely responsible for fulfilling orders, including packaging, shipping, and handling returns.

Payments and Fees

  • Payments are processed through secure third-party payment gateways. Afro-Asian Express does not store payment information.
  • Vendors agree to pay any fees or commissions as outlined in our Vendor Agreement.

Shipping and Delivery

  • Vendors are responsible for setting shipping policies, including delivery timelines and fees.
  • Buyers should refer to each Vendor’s specific shipping policies before making a purchase.

Returns, Refunds, and Cancellations

  • Vendors are required to clearly state their return, refund, and cancellation policies on their product listings.
  • Buyers should communicate directly with Vendors regarding returns and refunds. Afro-Asian Express may, at its discretion, mediate disputes but is not obligated to resolve them.

Dispute Resolution

  • Disputes between Buyers and Vendors should be resolved directly between the parties. Afro-Asian Express may, but is not required to, assist in resolving disputes.

Intellectual Property

  • All content provided by Vendors (e.g., product images, descriptions) remains the property of the respective Vendor. By listing products on the Platform, Vendors grant Afro-Asian Express a non-exclusive license to display and promote their content.
  • The Platform’s design, graphics, and other proprietary features are the property of Afro-Asian Express and are protected by copyright, trademark, and other applicable laws.

Prohibited Activities

Users agree not to engage in any activities that:

  • Violate any laws or regulations;
  • Infringe upon the rights of others;
  • Disrupt the operation of the Platform;
  • Involve the use of bots, scripts, or other automated tools to access the Platform.

Termination and Suspension

  •  Afro-Asian Express reserves the right to suspend or terminate any account that violates these Terms, engages in prohibited activities, or for any other reason deemed necessary at the sole discretion of the Company.

Limitation of Liability

To the fullest extent permitted by law, Afro-Asian Express shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of the Platform, including but not limited to transactions between Buyers and Vendors.

Disclaimer of Warranties

The Platform is provided “as is” and “as available.” Afro-Asian Express makes no warranties, express or implied, regarding the operation, availability, or reliability of the Platform or the products sold through it.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising under these Terms shall be resolved in the courts of the United Kingdom.

Changes to Terms

 Afro-Asian Express reserves the right to modify these Terms at any time. Users will be notified of significant changes through the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the new Terms.
